First-Time Drug Offenses Don’t Have to Mean Jail Time

Texas hasn’t been as hard-hit by the opioid epidemic as many other places, but it has still seen nearly a tripling of some drug-related problems, including overdose deaths, since 2000. With drug use and drug prosecutions up nationwide, many people who would otherwise have no contact with law enforcement find themselves facing drug possession charges that include jail or prison time.

Many argue that the best way to deal with all criminal offenses, even minor ones, is with incarceration, but others recognize that, in many cases, a different solution is more effective. It can benefit the individual offender, as well as the government, to keep people out of jail, especially for nonviolent crimes.

If you’re facing a first-offense drug charge in Tarrant County (including the city of Fort Worth), jail time is not inevitable. Tarrant County offers an alternative.

An Alternative and Dismissal

Tarrant County allows first-time drug offenders accused of certain crimes (primarily possession) to avoid jail time by entering a special supervision program. If the accused successfully completes the program (which runs ninety or 180 days, depending on the offense) the charge will be dismissed. The accused can then take steps to have the charge expunged completely.

Similar programs also exist at the state level for various offenses, and have been effective in multiple ways, benefiting not only the state’s bottom line but also convicted individuals, who frequently succeed in rehabilitation programs and usually commit additional crimes at lower rates than those sent to prison.

Commitment Required

On the other hand, Tarrant County’s First Offender Drug Program is not without cost or risk. To enter it, the accused gives up the right to a trial and agrees to plead guilty. There’s an upfront cost (up to $550), and the accused must submit to drug and alcohol testing and attend an education program while enrolled.

No drug or alcohol use is allowed during the program period, and any violations will land the accused back in court to face regular sentencing (with that guilty plea still in the hands of the district attorney). Some of the offenses eligible for this program ordinarily have a maximum sentence of two years and a $10,000 fine.

Know Your Choices

This program isn’t right for everyone, and it isn’t available to every defendant or in every case. But it’s important to know the options when you’ve been accused of a minor drug crime. This might be the best way to approach your case, since it could spare you the expense of a trial. It also might allow you to keep your job and stay with your family the whole time, instead of spending months in jail.
